Frequently Asked Questions (FAQs)

1

What is a Notary Public?

A Notary Public is a trusted individual appointed by the state to serve as an impartial witness in the execution of important documents. Their duties include administering oaths and affirmations, verifying identities, and performing other legally authorized notarial acts.

2

What is a Mobile Notary?

A mobile notary is a commissioned notary public who travels to your location to perform notarial services. Because they provide the added convenience of coming to you, mobile notaries typically charge higher fees to cover travel-related costs such as mileage, fuel, tolls, parking, and time spent in transit.

3

What is eNotarization?

Electronic notarization (or e-notarization) closely mirrors the traditional notarization process. The signer and notary are physically present in the same location, but instead of signing paper documents, all signatures and seals are applied electronically.

It’s important to note that while some states allow e-notarization, they may not permit remote online notarization.

4

What is Remote Notarization?

Remote online notarization is a fully digital process that allows the signer and notary to complete the notarization from separate locations. Using secure audio-visual technology via a phone, tablet, or computer, documents are signed and notarized electronically - no in-person meeting required.

5

What is the difference between a Mobile Notary and a Notary Signing Agent?

The key difference between a Mobile Notary and a Notary Signing Agent (NSA) lies in the scope of their work. While Mobile Notaries handle a broad range of documents, Notary Signing Agents specialize in facilitating and notarizing loan and mortgage documents.

Both roles require a traditional Notary Public commission. However, NSAs must also pass an annual background check and certification exam. Additionally, some states impose specific regulations on notarizing real estate documents, which may require further licensing or qualifications.

6

How can I best prepare for my notary appointment?

If you need a document notarized, there are a few important things to know before your appointment. Texas state law requires that certain conditions be met for a notarization to be valid, including proper identification, the signer’s mental competence, and their willingness to sign the document without coercion.

7

Proper ID and Credible Witnesses for ID Purposes:

To complete a notarization in Texas, signers must present a valid, unexpired government-issued photo ID that includes a visible signature. Acceptable forms of identification include:

  • Texas Driver’s License

  • State-issued ID Card

  • U.S. Passport

  • U.S. Military ID (Note: Cannot be photocopied or photographed)

  • Foreign Passport (Only accepted for identification in real estate transactions within Texas)

Using a Credible Witness for Identification

Texas law also allows for the use of a credible identifying witness when the signer does not have acceptable ID.

A credible witness must:

  • Personally know the signer

  • Either personally know the Notary or present a valid, unexpired government-issued photo ID with a signature

  • Be able to swear or affirm the identity of the signer before the Notary

This option is especially helpful when a signer’s ID is unavailable or expired, provided the witness meets the legal criteria under 1 TAC §§ 87.1 and 87.40.
